On 23 February 2022, the Commission adopted a proposal for a directive on corporate sustainability due diligence (“CS3D”) and on 1 December 2022, the Council adopted its negotiating position on CS3D. Stakeholders have brought to the Committee’s attention several potential areas of legal uncertainty in relation to the Directive and its intended application to the wholesale financial markets.
The FMLC has sent a letter to the European Commission some examples of legal uncertainty. It would value an opportunity to discuss the issues raised in the letter further.
