The FMLC has responded to the Insolvency Service’s consultation on the implementation of two UNCITRAL Model Laws. The letter considers the proposal to implement “Article X”, which would provide the courts with discretionary power to recognise foreign insolvency judgements and highlights specific examples of where the uncertainty created by Article X may be particularly problematic.
