The FMLC sent a letter to Nic Turner at the Ministry of Justice concerning the publication of a Government policy paper entitled Providing a cross-border civil judicial cooperation framework: a future partnership paper (the “Cooperation Paper”).  The letter was written pursuant to a request for comments on the Cooperation Paper from Mr Turner, originally addressed to Lord Walker.

The letter observes the similarities between the Cooperation Paper and an FMLC Paper published on 2 December 2016 and entitled Issues of Legal Uncertainty Arising in the Context of the Withdrawal of the U.K. from the E.U.—the Application of English Law, the Jurisdiction of English Courts and the Enforcement of English Judgments (the “FMLC Paper”), linked here.  The letter also recommends that the Ministry of Justice considers some of the more granular points made in the FMLC Paper, such as those which deal with issues of transition.
