The FMLC has sent a letter to Francis Evans at the Department for Business, Energy & Industrial Strategy (“BEIS”) concerning the draft Business Contract Terms (Assignment of Receivables) Regulations 2017 (the “Regulations”). The letter examines the Regulations from a conflict of laws perspective, and makes several recommendations as to their possible amendment (focussing, in particular, on Regulation 1 paragraph 3, and Regulation 2(a)).
